Required Implementation Rules

  • The checkbox must start unchecked.
  • The checkbox must be optional unless a specific message is technically necessary and legally permitted.
  • SMS consent must be separate from email consent and telephone-call consent.
  • Operational and marketing consent must use separate checkboxes and separate disclosure records.
  • Privacy Policy and SMS Terms links must be displayed near the checkbox and must resolve to the sender’s applicable policy and terms.
  • The system must record disclosure version, brand, program, time, source, user, telephone number, and consent action.
  • For customer-branded programs, the links must point to the customer’s Privacy Policy and SMS Terms, not only to VR Goals policies.

These disclosures are stricter than some minimum legal requirements because carriers and Telnyx review whether opt-in language is clear, specific to SMS, unbundled, optional, branded, and consistent with the campaign use case.
